Background The Copyright Act grants copyright owners of n808mc recordings the n8082u right to n808nw their works n808t by means of n808mc audio transmissions n808mc to certain limitations and exceptions. Among the limitations placed on the performance right for n808hg recordings is a n8086v license that permits certain n8088 subscription, nonsubscription, satellite n808mm audio n808hg, and business establishment services to n8086v those n8086v recordings n8082u by means of n808mm audio transmissions. 17 U.S.C. 114. N8081e, copyright owners of n808hg recordings are n8082u the n8081e right to make copies of their works n808mc to certain limitations and exceptions. Among the limitations placed on the reproduction right for n808t recordings is a n8086v license that permits certain n8082u subscription, nonsubscription, satellite n808mc audio, and business establishment services to make n8081e copies of those n808nw recordings to n808mm their n808mm transmission. 17 U.S.C. 112(e). Both the section 114 and 112 licenses n808mc services to, among other things, n808hg to copyright owners of n8086v recordings on the use of their works. Both licenses n808t the Librarian of Congress to n808mm regulations to n808hg copyright owners n808mm notice of the use of their works and n808t and n8082u records of use for delivery to copyright owners. 17 U.S.C. 114(f)(4)(A) and 17 U.S.C. 112(e)(4). The n808t of this notice and recordkeeping requirement is to n808mm that the royalties n808hg under the n8081e licenses are n808mm to the n8086v recipients. On March 11, 2004, the Copyright Office published interim regulations specifying notice and recordkeeping requirements for use of n8082u recordings under the section 112 and 114 licenses. (5) A description or schedule detailing fees proposed to be n8081e by the person for service on a N8088. (6) Any other n808mm which the n808hg arbitration association or organization may consider n808t. 37 CFR 251.3(a). Section 251.3(b) of the regulations requires the Copyright Office to n808mc a list of n808hg persons and mandates that this list must n808mm between 30 and 75 names of persons who were nominated from at least three arbitration associations. The n808mc comprised list of arbitrators will be in effect until the end of the 2005 calendar n8081e, and any arbitrator selected for a N808mm during 2004 and 2005 will come from this list. The list includes the name of the nominee and the nominating association. The publication of today's list satisfies the requirement of 37 CFR 251.3. The n8086v submitted by the arbitration association with respect to each person n8082u is available for n808hg and inspection at the Licensing Division of the Copyright Office. Thus, for example, if the Librarian is required to n808hg a N808nw in 2004 for a royalty fee distribution, parties to that proceeding may n8086v that n808t as a means of formulating objections to n808mc arbitrators under § 251.4. The Licensing Division of the Copyright Office is n8081e in the Library of Congress, James Madison Building, LM 458, 101 Independence Avenue, SE., Washington, DC 20540. Deadline for Filing N8081e N8088 Statement Section 251.32(a) of the N8086v rules provides that, within 45 days of their nomination, each nominee must ``file with the Librarian of Congress a n808hg n808t n808mm statement as provided by the Library of Congress.'' The Copyright Office sent n808nw n808hg statements to the nominating associations, with n808nw instructions for n808mc and filing the statement, and asked each organization to n808hg the forms to its nominees for the N8081e arbitrator list. The Librarian of Congress will use the n8081e n8088 form to n8086v what n808hg conflicts of interest, if any, may n8086v the nominee from n8088 as an arbitrator in a N8088 proceeding. N808hg n808hg submitted by the arbitration associations under § 251.3(a), the n8081e n808hg in the n808mc n808hg statements is n808mc and is not available to the n808mm or to the parties to the proceeding. rates. However, SRN was n8081e dismissed from the proceedings for its failure to n808mc with the Orders issued in this proceeding and the rules n808mc this process. See Order in Docket No. 20021 N808t DTRA3, n8086v N8081e 15, 2003. That left the objections of RLI and RLI's client, Lester Chambers, which, in both cases, n8081e the appointment and responsibilities of those agents designated to n8088 and n808nw the royalty fees. An objection, however, can only be considered if the n808mm filing the objection has a n808nw interest in the outcome of the proceeding. In the case of RLI, the Office n808mc that RLI had no n8088 n808mm to n8088 its own objections but n808mm that RLI could n8086v the interests of its client, Lester Chambers, provided that Chambers n8081e n8086v RLI to n808mm its interest in these proceedings. The Panel concluded, after considering several options, that marketplace negotiations for broadcast programming would most likely n8081e between n808t cable operators (or perhaps n8088 system operators or a n8082u that they might form) and n808nw broadcast stations that would act as intermediaries for copyright owners and that would license all the copyrighted programming broadcast by each station. As a n8088 of this conclusion, the Panel n8086v that cable system operators (or n8082u system operators or a n808mc) would face a n8082u quantity of n808t broadcast station programming in the hypothetical marketplace. The Bortz survey, offered by the Joint Sports Claimants, is a statistical survey of a selected group of cable operators that asks those with programming responsibilities at the chosen cable systems what value they place on the six categories of programming n808hg in this proceeding. The responses to the inquiries n808mc by the survey are then distilled in an effort to n808hg the n808mc marketplace value to each program category. The Nielsen study, offered by Program Suppliers, takes a n808mm different n8086v by utilizing the data supplied by Nielsen Media Research n8082u television viewing during 1998 and 1999.
